What does the $350/class USPTO fee cover?

That is the US government's fee for processing a TEAS filing. It is paid directly to the USPTO and is not a TradeMaker charge. Every applicant pays this regardless of who prepares their application.

Which plan should I pick?

Basic covers complete, correct preparation. Standard adds rush turnaround, a deeper clearance report, and covers formality Office Actions — the most common USPTO pushback. What is the $200 non-compliant surcharge?

If your goods and services descriptions are not taken from the USPTO's ID Manual, the USPTO charges an additional $200 per class. Correct preparation eliminates this surcharge entirely — on every plan.

Do I need a trademark attorney?

TradeMaker is built for applicants who want a structured, guided process for preparing their own application. However, we always recommend consulting a licensed trademark attorney if your situation involves potential conflicts, prior refusals, international filings, or if you want a legal opinion on the registrability of your mark. We refer clients to Melivate Group for these needs.

How long does the process actually take?

The USPTO typically begins examination 3–6 months after filing. Full registration — assuming no Office Actions or oppositions — usually takes 12–18 months from the filing date. TradeMaker helps you start correctly; the timeline after filing is determined by the USPTO.

What if my application is refused?

A non-final Office Action gives you 3 months to respond. Formality issues (descriptions, specimens, administrative items) are included in Standard and Premium, and available from $149 on Basic. Likelihood-of-confusion and descriptiveness refusals are legal matters — Melivate Group can assist.

Is the class search really free?

Yes. The class search costs nothing, requires no account, and your results carry into any plan automatically. It is how every filing should start.
