A trademark is any word, name, symbol, logo, slogan, sound, or combination thereof that identifies and distinguishes the source of goods or services from those of others.
Examples: NIKE (word mark), the Nike swoosh (logo), Just Do It (slogan), the NBC chime (sound).
Key principle: Trademark rights come from *use in commerce*, not registration. But federal registration gives you four critical advantages:
1. Legal presumption of nationwide ownership
2. Ability to use the ® symbol
3. Basis to block infringing imports through U.S. Customs
4. The right to file in federal court without proving actual damages
