1. Services

TradeMaker ("we," "us," "our") provides trademark filing preparation and support services. We are not a law firm and do not provide legal advice. Our services are document preparation services only. Use of our platform does not create an attorney-client relationship.

2. Fees & Payments

Our service fees are separate from USPTO government filing fees. You are responsible for both:

  • TradeMaker service fee (Basic: $199 · Standard: $299 · Premium: $499 per application). The class search is free.
  • USPTO base application fee: $350 per class (effective January 18, 2025, the USPTO replaced the former TEAS Plus / TEAS Standard fees with a single base fee). Additional USPTO surcharges may apply: +$100/class for incomplete applications, +$200/class for goods/services not taken verbatim from the USPTO ID Manual, and +$200 per additional 1,000 characters of free-form goods/services text. Fees are subject to change — confirm current amounts at uspto.gov.

All payments are non-refundable once filing preparation has commenced.

3. No Legal Advice

TradeMaker's AI tools, class suggestions, conflict searches, and any communications from our support team do not constitute legal advice. For legal representation, you should consult a licensed trademark attorney. TradeMaker assumes no liability for refusals, office actions, or disputes arising from filings prepared using our service.

4. User Responsibilities

You represent that all information submitted is accurate and that you have the right to use the trademark you are filing. You are responsible for responding to any USPTO office actions within required deadlines. TradeMaker will notify you of status updates but is not responsible for missed deadlines.

5. Intellectual Property

All content, tools, and software on TradeMaker are owned by TradeMaker and protected by intellectual property laws. You may not copy, reproduce, or distribute any portion of the platform without written permission.

6. Limitation of Liability

To the maximum extent permitted by law, TradeMaker's total liability to you for any claims arising from use of our services shall not exceed the amount you paid us in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages.

7. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
